Terms of Service

To ensure that our goals are aligned and intent is clear from the start, we’ve carefully crafted our Terms of Service to safeguard your investment in our partnership.

1. Acceptance of Terms

By subscribing to a Livingstones Studio plan (“Subscription”), you acknowledge that your organization (“Organization”) has read and understood these Terms and Conditions (“Terms”), agrees to comply with and be bound by them, and that you have the authority to enter into such an agreement.

These Terms constitute the entire agreement between the Organization and Livingstones Studio, LLC (“Studio”) in using the Subscription.

2. Subscription Plans

  • The Subscription is offered with a variety of different plans, each coming with its own features, limitations, and pricing.
  • One of these limitations is the number of active (or concurrent) requests. At any given time the Studio will only work on the number of requests allowed for in the Organization’s plan.
    • For example, if the Organization’s plan allows for only one active request, the Studio will only work on one request at a time until its completion and final approval from the Organization. This includes delays incurred because of review and approval time, requests for clarification and context, etc.
    • If the Organization’s plan allows for two active requests, the Studio will still work on requests one at a time. However, once the first request is pending feedback or response from the Organization, the Studio will begin (or resume) work on the second request. If all active requests are pending feedback or response from the Organization, work on the Organization’s requests will completely stop until at least one of the tasks is sufficiently addressed by the Organization.
  • Turnaround times can vary for a variety of reasons, but primarily this is impacted by the type of request, its complexity, its scale, the detail provided in the initial briefing, and the timeliness of the Organization in responding to questions and providing feedback.
  • The Subscription does not operate under timelines, however, the Organization can make known its needs and the Studio will do it’s best to deliver.
  • The Studio operates on a typical business week (Monday–Friday), so turnaround estimates are based on this working schedule.
  • Each request will be worked on based on the priority the Organization assigns it when creating the request. This order can be changed at any point by the Organization.
  • The Subscription may change and evolve over time, so the plans listed on our website may not always reflect what the Organization is subscribed to, even if they share the same name. Please consult the Organization’s ClickUp space for up-to-date information on the Organization’s active plan.

3. Billing and Payment

  • Payment will be charged automatically using the payment method the Organization provided during signup.
  • By subscribing to the Subscription, the Organization agrees to pay the associated fees each month in perpetuity until such a time as the plan is paused or canceled.
  • Subsequent charges will occur on the same day as original payment each calendar month, or on the last day of the month in the case of shorter months. For example, if the Organization subscribes to the Subscription on January 31st, it will be changed on the 30th of the month when there aren’t 31 days, or in the case of February it would be charged on the 28th or 29th during leap years.
  • Prices are subject to change, but changes will not affect the current billing cycle. The Organization’s plan’s pricing will be honored for the next billing cycle as well, allowing the Organization greater flexibility and time to budget accordingly.
  • Plans can be canceled or paused at any time by the Organization, which will prevent recurring charges after the current billing cycle.
  • All payments are non-refundable.

4. Ownership

  • All work performed or created on the Organization’s behalf is completely owned by the Organization and it can do whatever it wants with it.
  • The Studio retains a worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt, and publish any and all work performed or created solely for the purpose of displaying, distributing, and promoting the Studio. By submitting content the Organization represents and warrants that it has the right to grant such a license and that the content does not infringe any third-party rights.
  • Resources provided as a part of the Subscription or assets of the Studio’s brand may not be used by you or the Organization without written permission beforehand, all work created for the Organization is not included in this restriction.
  • You or the Organization may not resell, distribute, or sublicense any of the aforementioned resources obtained through the Subscription.
  • The Organization is granted a non-transferable license to these resources for the duration of your subscription.

5. Termination

  • The Organization can cancel or pause its subscription at any time, but no refunds will be provided for the remaining billing cycle.
  • The Organization will maintain access to the Subscription through the remainder of the billing cycle.
  • The Studio reserves the right to terminate or suspend the Organization’s subscription without notice in case of violation of these Terms.

6. Changes to the Subscription

  • The Studio may modify, suspend, or discontinue any part of the Subscription or Terms at any time without prior notice including but not limited to features, offered services, limitations, and pricing.
  • Such modifications shall be effective immediately, except where stated otherwise, upon posting the modified Terms on the Studio’s website. The Organization’s continued use of the Subscription afterward constitutes its acceptance of the modified Terms.
  • We will always inform the Organization when the Terms have been modified.

7. Privacy

  • Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and safeguard your personal information.

8. Limitation of Liability

  • The Studio strives to provide accurate and reliable work and resources, but we cannot guarantee the suitability or accuracy of the content created for the Organization’s specific needs.
  • The Studio is not liable for any damages arising from the Organization’s use or inability to use the Subscription.

9. Faith & Belief Requirements

Ministries

  • Because of the Studio’s commitment to the integrity of Christ’s bride, the church, the sovereignty of God, and biblical fidelity, the Studio will only work with ministry organizations (ministries) that are confessional and committed to reformed theology.
  • Ministries must hold to at least one of the following confessions:
    • Westminster Confession of Faith (1647)
    • American Westminster Confession of Faith (1788)
    • Three Forms of Unity (Belgic Confession, Heidelberg Catechism, and Canons of the Synod at Dordt)
    • London Baptist Confession of Faith (1689)
    • 39 Articles of Christian Religion
  • Ministries must also agree with all of the following statements:
  • While confessionalism is a great safeguard against false theology and heresy, it does not necessarily preclude it. For this reason, the Studio reserves the right to evaluate the Organization (and reevaluate it at any time) and can determine not to partner with it or terminate partnership if the Studio finds it in error or at odds with the Studio’s own beliefs.

Businesses

  • While we do not require business organizations (businesses) to be reformed or even Christian, we will only work with like-minded people. One of our aims is to help build a parallel economy, fostering a growing society and reducing the reliance on and influence of corporations and the woke agenda.
  • This is a bit harder to define outside of the ministry context, so we reserve the right to refuse partnership with any businesses for any cause.
